If Open Desk is down
This is operating guidance, not legal advice. Keep it with your own procedures. The clock does not stop because the website is down.
- A Right-to-Know request is due five business days after the open-records officer received it, whether or not Open Desk is working.
- Keep the request. Write down the date and time it arrived and who received it. Save the original email, letter, or note.
- Count the five business days yourself, skipping weekends and the days your office is closed. When you are unsure, use the earlier date.
- If you need more time and a reason in § 902 applies, send the written notice before the fifth business day. Name the reason, the date a response is expected, and an estimate of fees.
- When Open Desk is back, enter the request with the date and time it actually arrived. Do not enter today's date if that is not when it arrived.
- Do not tell the requester to wait for Open Desk. Respond on your own letterhead if you must.
